ZHB MEETINGS
Borough Zoning Hearing Board meets on the second Tuesday of each month, only when there is business before the Board at 7:00 P.M. The Meetings are conducted in Borough Council Chambers, 2nd Floor, 304 South State Street.
ROLE/DUTIES OF THE ZONING HEARING BOARD
The role/duties of the Clarks Summit Borough Zoning Hearing Board are defined by the Borough's Zoning Ordinance. Additionally, this local government role is defined by state law in an act known of the "Municipalities Planning Code (MPC)".
The Zoning Hearing Board is a quasi-judicial body. All hearings are attended by a stenographer. The Board has its own Solicitor, who advises the Board in legal matters and writes opinions following a decision. Borough Council establishes the Board annual budget and makes appointments to the Board. The Board, applying the Borough's own "Zoning Ordinance" sits in judgment of the Applicant's case and/or a decision by the Borough's Codes Enforcement (C.E.O.)/Zoning Officer. Decisions of the Board (by either the Applicant or the Borough) may appealed to the Lackawanna County Court of Common Pleas, in Scranton, Pennsylvania.
SUBMISSIONS TO THE ZONING HEARING BOARD
The requirements for submissions to the Clarks Summit Zoning Hearing Board can be found in the Borough's "Zoning Ordinance". In addition, a complete application is also required. Incomplete applications/ documentation and/or fees received at the time of submission will be returned to the Applicant without action by the Borough.
MINUTES OF ZHB MEETINGS/HEARINGS
The Minutes of all Zoning Hearing Board Meetings are available for public viewing under the "Open Records Act". The Minutes are maintained at the Administrative Offices of the Borough, located on the 2nd Floor, 304 South State Street, Clarks Summit.
